Please note that the DLBA is entitled to a tax capture for five (5) tax years following the transfer of ownership. This tax capture may be incompatible with certain tax abatements and/or lot combinations otherwise available to the selected purchaser. Requests to waive the DLBA’s tax capture rights will be reviewed on a case-by-case basis and may require a payment in lieu of taxes (PILOT). Any such payment will be determined based on the proposed development pro forma and the impact of tax abatements on purchase and financing.
