MANNER OF SALE: This real estate will be offered as a MULTI-PARCEL auction in 8 individual tracts and in combinations of tracts. It will be sold in the manner that produces the highest aggregate bid. There will be OPEN BIDDING on all tracts and combinations of tracts during the auction as determined by the auction company. Bids on individual tracts, tract combinations, and the total property may compete. Auction procedure and increments of bidding are at the discretion of the auction company.
TERMS: 10% down day of sale, with the balance to be paid on or before November 30, 2012, or upon such terms as may be acceptable to the Sellers. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by the auction company in their trust account or by an identified title/escrow company. Bidding is not contingent upon financing. Financing, if necessary, needs to be arranged and approved prior to the auction. Announcements made day of sale take precedence over printed material and previously made oral statements.
MINERAL RIGHTS: All of the Sellers interest will transfer to the Buyer(s) at closing, including gas production on Tract 1. See chart on back for Sellers mineral interests.
CROPS: There are approximately 290 acres that will be planted to wheat this fall and Buyer(s) will receive 100% of the 2013 wheat crop.
FSA INFORMATION: Buyer(s) will receive 100% of all FSA payments associated with the 2013 crop year, if any.
CRP PAYMENTS: Buyer(s) will receive 100% of the 2013 CRP payments on Tracts 5, 6, and 7 which will accrue from 10/1/12 thru 9/30/13.
CLOSING: Closing will be on or before November 30, 2012.
POSSESSION: Date of closing, except January 1, 2013, on the farmstead.
REAL ESTATE TAXES: Sellers will pay taxes for 2012 and prior years. See chart on back for 2011 tax amounts.
EVIDENCE OF TITLE: Seller will provide title insurance to the Buyer(s) in the amount of the purchase price with the premium to be paid one-half by the Buyer(s) and one-half by the Sellers. Title evidence will be provided on sale day.
SURVEY: In the event Tracts 1 and 2, or 5 and 7, sell separately at the auction, Sellers will provide a survey of the tracts to establish a legal description sufficient to provide title insurance and convey title to the Buyer(s).
ACCEPTANCE OF BIDS: Each successful bidder will be required to enter into a real estate purchase contract immediately following the auction. Copies of the contracts will be available from the auction company prior to the sale.
ACREAGES: Acreage figures are considered to be approximate and are from reliable sources, based on (USDA) FSA figures. All FSA information is subject to change. FSA acres may not be the same as deeded acres. Acreages are not covered by title insurance.
INSPECTIONS: Each potential bidder is responsible for conducting their own independent inspections and due diligence concerning pertinent facts about the property. Neither Seller or Farm & Ranch Realty, Inc., its agents or representatives, are making any warranties about the property, either expressed or implied.
EASEMENTS: This sale is subject to all rights-of-way and easements, whether recorded or not, and to an oil and gas lease of record.

Tract 7 features a 2 bedroom house, 2 baths, W.B. fireplace in livingroom, basement which includes a cellar, bedroom, plus kitchen area, and 24x48 garage, 32x60 roundtop quonset, 50x100 Morton building, and other supporting outbuildings.
AUCTIONEERS NOTE: Lucille Mai has decided to liquidate her land and machinery in Greeley County, Kansas. This farm has been in the family since the 1930s and has been well cared for and maintained thru the years. The farm has a great farmstead with a modern two bedroom house, 1,100 acres of near level cropland and 400 acres of good pasture. The Mais will plant the fall wheat and give possession of the house and pasture on Jan. 1, 2013. The mineral rights are nearly 100% intact with one gas well included with the sale of Tract 1. We will offer the farm in tracts and in combinations of tracts. Call Don for further details or for an appointment to view the house and outbuildings.
The machinery will be sold on Friday, Oct. 19th at the farmstead. This is mostly older equipment with lots of miscellaneous merchandise including antiques and collectables from as far back as the turn of the century.
