Tract 1 has a manure easement from the Tract of land east of the property. Seller shall not grant a perpetual easement for manure disposal as provided in the Original Offer. However, Seller shall grant Buyer an easement for manure disposal on land owned by Seller located in the Southeast Quarter of Section 33, Township 24 North, Range 3 East, Stanton County, Nebraska, (Subject Property) with the term of the easement to end on March 31, 2017, and the Buyer only permitted to dispose of manure on the Subject Property after crop harvest on the Subject Property each fall and before crop planting on the Subject Property each spring. Buyer agrees that any waste material shall be distributed in accordance with good farming practices and shall at all times comply with all applicable Federal and Nebraska state laws and regulations regarding environmental conditions applicable to the distribution of the waste material.

Terms of Auction: The successful bidder will be required to enter into a written purchase agreement with a 10% down payment the day of the auction. The balance will be due at closing on or before January 27, 2012. Full possession available at closing. Seller will provide marketable title to the Buyer, evidenced by a policy of title insurance. Cost of title insurance will be divided equally between Seller and Buyer. The 2011 and prior real estate taxes will be paid by Seller. Property will not be sold subject to financing. Please have all financial arrangements made prior to the auction. All announcements the day of the auction will take precedence over anything written or implied.
