AUCTION TERMS AND CONDITIONS
PROCEDURE
The real estate which is the subject matter of this auction will be offered in two (2) separate parcels and as a combined parcel. The bid procedure shall be flexible and shall be designed to achieve the greatest sale price.
DOWN PAYMENT
A 10% non-refundable down payment will be due from each successful bidder on the day of the auction. The down payment may be made in the form of a cashiers check, personal check, or corporate check. No bids subject to financing will be accepted.
PURCHASE AGREEMENT
The successful bidder or bidders will be required to enter in to a Purchase Agreement at the auction immediately following the close of the auction. The final bid price is subject to sellers acceptance or rejection.
EVIDENCE OF TITLE
Seller at Sellers expense shall provide to the successful bidder or bidders an owners title insurance policy in the amount of the purchase price.
CONVEYANCE OF TITLE
Seller shall provide a Corporate Warranty Deed to Buyer for the subject real estate.
CLOSING
The balance of the purchase price is due at closing. The closing will take place on or before Monday, October 21, 2013. The closing will take place at Land Title Agency, Inc., 209 West Washington Street, Rensselaer, Indiana 47978. The closing costs shall be shared 50/50 between the Seller and successful bidder or bidders.
POSSESSION
Seller shall grant Buyer possession on January 1, 2014.
REAL ESTATE TAXES
Seller shall assume and pay the 2013 real estate taxes due and payable in May and November 2014, by virtue of a credit to be given to Buyer at closing. Buyer shall pay the real estate taxes for the year commencing 2014 due and payable in 2015 together with any ditch assessments due in the year 2014.
