MANNER OF SALE: This real estate will be offered as a MULTI-PARCEL auction in 10 individual tracts and in combinations of tracts. It will be sold in the manner that produces the highest aggregate bid. There will be OPEN BIDDING on all tracts and combinations of tracts during the auction as determined by the auction company. Bids on tracts, tract combinations, and the total property may compete. Auction procedure and increments of bidding are at the discretion of the auction company.
TERMS: 10% down day of sale, with the balance to be paid on or before December 14, 2012, or upon such terms as may be acceptable to the Sellers. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by the auction company in their trust account or by an identified title/escrow company. Bidding is not contingent upon financing. Financing, if necessary, needs to be arranged and approved prior to the auction. Announcements made day of sale take precedence over printed material and previously made oral statements.
MINERAL RIGHTS: Sellers will retain 50% of the existing mineral rights for a term of 10 years, or as long as production, if any, exists. Said reservation will be non-participating in lease monies, delay rentals and bonuses, but fully participating in royalties. There are no current oil and gas leases on any tract.
CROPS & CROP INSURANCE: Buyer(s) will receive 100% of the 2013 wheat crop, if any. There are 80.1 acres on Tract 1 and 52.3 acres on Tract 5 planted to wheat.
There is RP crop insurance in effect on the 2013 growing wheat at the 70% level thru Colorado Federal Agency, Inc., Burlington - Seller agrees to transfer all rights of indemnity to the Buyer(s) at closing with Buyer(s) agreeing to pay the premiums and receive any benefits therefrom.
FSA INFORMATION: Buyer(s) will receive 100% of all FSA payments associated with the 2013 crop year, if any. See chart on back for bases and yields.
CRP INFORMATION: Buyer(s) will receive 100% of the 2013 CRP payments on Tracts 2, 3 and 9. See chart on back for CRP payment amounts and expiration dates.
CLOSING: Closing will be on or before December 14, 2012.
POSSESSION: Date of closing, subject to tenants rights, if any, thru December 31, 2012.
REAL ESTATE TAXES: Sellers will pay taxes for 2012 and prior years. See chart on back for 2011 tax amounts.
ACREAGES: Acreage figures are considered to be approximate and are from reliable sources, based on (USDA) FSA figures. All FSA information is subject to change. FSA acres may not be the same as deeded acres. Acreages are not covered by title insurance.
INSPECTIONS: Each potential bidder is responsible for conducting their own independent inspections and due diligence concerning pertinent facts about the property.
