19.4 mostly tillable acres of Elkinsville silt loam. It has frontage on Bald Knob Road (1,337 frontage) and Mackey Ferry Road (662 frontage).

Tract 2

76.24 acres located at the corner of Hwy 62 (1,300 frontage with limited access) and Old Hwy 69S (2,400 frontage with limited access). It also has frontage on Mackey Ferry Road (833 frontage) and Weilbrenner Road (2,120 frontage). The predominant soil types are Uniontown Silt Loam, Alford Silt Loam and

Evansville Silt Loam.

Tract 3

TERMS AND CONDITIONS

ACREAGES

All tracts have a current survey conducted by Morley and Associates and will be conveyed according to the newly surveyed acreages.

ZONING

Tract #5 and a small part of the western section of Tract #9 along Old State Highway 69 are zoned residential. The remainder of Tract #9 and all of the other tracts are zoned agricultural.

MINERALS AND OIL INCOME

The buyer will receive any and all coal, oil, gas and other mineral rights, owned by the seller, for the auctioned properties. The seller has not done a mineral title search; no representations or warranties are given as to the amount of coal, oil, gas and mineral rights owned by the seller, if any.

2011 REAL ESTATE TAXES

Alma Black Heirs Farm (Tracts 1, 2 & 3), combined annual real estate taxes - $1,664.10; Marrs 53 Farm (Tract 4), annual real estate taxes - $1,345.10; Seibert Farm (Tracts 5, 6, 7, 8 & 9), combined annual real estate taxes $8,008.08. The buyer will be responsible for the Spring 2012 tax installment and any installments thereafter.

CROP INCOME

The buyer will receive the 2012 crop income.

TITLE

The seller will provide the purchaser with evidence of marketable title. This is available upon request and will be posted at the auction. The purchaser is responsible for paying all premiums associated with title insurance, if title insurance is desired.

DEED

Deed of conveyance will be by Trustees Deed.

TERMS

The purchaser is to pay 10% of the purchase price as down payment at the auction site at the conclusion of the bidding. The balance will be due with the delivery of the deed on or before March 30, 2012.

There is no buyers premium; normal and customary closing costs will apply.

POSSESSION

Possession and full farming rights will be conveyed with the delivery of deed at closing.
