AUCTION TERMS AND CONDITIONS

PROCEDURE

The real estate which is the subject matter of this auction will be offered in one unit.

DOWN PAYMENT

A 10% non-refundable down payment will be due from each successful bidder on the day of the auction. The down payment may be made in the form of a cashiers check, personal check, or corporate check. No bids subject to financing will be accepted.

PURCHASE AGREEMENT

The successful bidder or bidders will be required to enter into a Purchase Agreement at the auction immediately following the close of the auction. The final bid price is subject to sellers acceptance or rejection.

EVIDENCE OF TITLE

Seller shall provide to the successful bidder an owners title insurance policy in the amount of the purchase price.

CONVEYANCE OF TITLE

Seller shall provide a Warranty Deed to Buyer for the subject real estate.

CLOSING

The balance of the purchase price is due at closing. The closing will take place on or before Friday, December 14, 2012. The closing will take place at Jasper County Abstract located at 119 North Cullen Street, Rensselaer, Indiana 47978. The closing costs shall be shared 50/50 between the seller and successful bidder or bidders.

POSSESSION

Seller shall grant Buyer possession at closing.

REAL ESTATE TAXES

Seller shall assume and pay the 2012 real estate taxes due and payable in May and November of 2013 by virtue of a credit to be given to Buyer at closing. Seller shall assume and pay the ditch assessments for 2012 through the date of sale. Buyer shall pay the real estate taxes for the year commencing 2013

due and payable in 2014 together with any ditch assessments due in the year 2013.
